In its motion on Tuesday, Apple denied it was a monopoly and filed a counter-action claiming epic was violating its contract. «In the dark hours of the night, Epic launched its sneaky scheme to break its agreements and ride freely with Apple`s investments,» Apple wrote in the dossier. An Apple spokesman said the company was grateful that the court «recognized that Epic`s actions were not in the best interests of its own customers and that any problems they may have encountered were caused by themselves when they violated their agreement.» The spokesperson added that Apple`s App Store was «an economic miracle» that had created «transformative business opportunities» for developers. She denied that her 30% commission was anti-competitive and said the fight was «a fundamental disagreement over money.» Apple had said it would allow Fortnite to return to the store if Epic removed the direct payment function to comply with its development agreement. «The prosecution of Epic is nothing more than a fundamental disagreement over money,» Apple said in its complaint. «While Epic presents itself as a modern Robin Hood company, it`s actually a multi-billion dollar company that doesn`t want to pay for the huge value it receives from the App Store. Epic`s calls for special treatment and calls for «retaliation» cannot be reconciled with its flagrant breach of contract and its own business practices, as it earns billions by taking commissions on the sale of game developers and charging consumers up to $99.99 for «V-Bucks» packages. The next day, Apple Epic Games announced that due to its violations of App Store policies and the licensing agreement for developer programs, it would revoke all development tools that would exclude updates to other programs, including the Unreal engine, by August 28. Epic Games subsequently filed an application for initiative against Apple. Apple says the App Store`s 30 percent commission helps pay for the fees it represents for the app host. This includes security, as it helps the company download apps directly from the App Store to make sure they meet certain standards and are safe — which is especially important when it comes to credit card information. In its complaint, Apple seeks a jury trial on all matters.
Neither Apple nor Epic immediately responded to TechRepublic`s request for advice. Companies such as Facebook, Spotify and match Group have backed Epic Games in their lawsuits and have talked about their own problems in the past with Apple`s App Store guidelines regarding their services.  Digital Content Next, a non-profit trading group representing media outlets such as The New York Times and The Wall Street Journal, also backed Epics` lawsuit, saying in particular that Apple had made unique offers to some suppliers such as Amazon, but not to others.  Apple rejected the Fortnite game maker`s claims that its control over the App Store gave it a monopoly. Epic Games sued Apple in August after the company`s hit game Fortnite was removed from the iOS App Store due to the implementation of an unauthorized payment system. The complaint, filed on August 13, alleges that Apple is violating cartel law by using its full control over iOS to extract a commission on all software that passes through the App Store. Epic immediately filed separate complaints against Apple and Google for anti-competitive and anti-competitive conduct in the United States District Court for the Northern District of California.
